AMCON took over management of Arik Air in 2017 and appointed Kamilu Omokhide as the airline’s receiver.
In 2021, Arik Air’s founder, Sir Johnson Arumemi Ikhide, and his wife, Mary Arumemi Ikhide (plaintiffs), filed an originating motion on December 14, 2021, requesting the court that the duty imposed on the receiver-manager, Kamilu Omokhide (first defendant), by section 553 of the CAMA 202O to act in the best interest of Arik Air Limited as a whole, includes the duty to act in the best interest of the plantiffs (Arumemi and Mary Ikhide) as members of Arik air Limited.
Arumemi-Ikhide also sought an order directing the first and second defendants to “permit the Directors and Shareholders of Arik Air Ltd unfettered access to their offices, premises of the Plaintiff, facilities, and staff necessary for the performance of their duties.”
On Tuesday, in accordance with the court order stating that the receivership of Arik Air does not preclude restricting access to the premises, the founder of Arik Air attempted to enter the airline’s premises.
However, he was stopped by the security guards at the entrance.
The airline’s Chief Security Officer, identified as D. Tom-West, stated that he was prohibited from entering the premises by an executive order.
In the subsequent dispute, the CSO asserted that he is only accountable to the receiver-manager.

He stated, “The receiver manager issued an order prohibiting your entry.” I am unfamiliar with the court order. We cannot provide you with access to the compound. The instruction from above is as follows.
I sincerely apologise for keeping you under the sun. We are authorised to deny you access. I am required to adhere to the receiver manager’s directive,” he stated.
Arumemi-Ikhide informed the CSO that he was not on the premises to harass or cause trouble, but rather to comply with the court order that granted him access to the airline’s premises.
He stated that he had a meeting with the Chief Operating Officer and Chief Financial Officer and that some offices should be reserved for him on Tuesday, to which they agreed.
He expressed surprise that he was being denied entry to the premises.
Later, the Chairman left the premises and went to the MMA Domestic Airport Division of the Nigeria Police Force to write a statement.
He stated that he would report back to his attorneys, who would then handle the situation.
