Appeal Court’s Certified Judgement Affirms Kano Governor Abba Kabir Yusuf’s Victory –Femi Falana SAN. 

 

In a twist of events, a certified copy of the Appeal Court judgment on the Kano State Governorship election has brought about confusion by affirming the victory of Abba Yusuf as the duly elected Governor. This revelation comes as the Court of Appeal sets aside the judgment of the Kano election petition tribunal, deeming it lacking in merit.

According to details revealed in the written judgment, specifically on page 67 of the released copy of the Appeal Court judgment, signed by the registrar, Mr Jameel Ibrahim Umar, the appellate court upheld the victory of Abba Kabiru Yusuf of the New Nigeria People’s Party (NNPP).

Recalling the events, the three-member panel of the Appeal Court, on Friday, November 17, 2023, dismissed the appeal filed by Governor Yusuf, citing concerns related to his membership status. In response, the appellate court affirmed Nasiru Yusuf Gawuna of the All Progressives Congress (APC) as the winner of the March 25, 2023, governorship poll in Kano.

Addressing journalists on Tuesday evening, the Kano State Attorney General and Commissioner for Justice, Haruna Dederi, highlighted that page 67 of the certified copy of the judgment unequivocally indicated the tribunal’s ruling that initially sacked Governor Yusuf was set aside.

Barrister Dederi, emphasizing the importance of the written evidence, insisted that it contradicts what the judges publicly announced in the courtroom on November 17. This development has sparked confusion and added complexity to the already contested Kano State Governorship election results.

Meanwhile, Femi Falana SAN said, the Kano Court of Appeal (CTC) has affirmed that the Tribunal’s judgment was erroneous and has subsequently overturned it. The court ruled in favour of Governor Abba K of the New Nigeria People’s Party (NNPP) by resolving all issues. Additionally, the court directed the All Progressives Congress (APC) to pay Governor Yusuf N1 Million Naira.
