The three-judge panel’s October 13 decision that released and acquitted the IPOB leader stood, according to Ejiofor, despite the Appellate Court’s reversed decision.

Kanu had given the legal team permission to appeal the decision at the Supreme Court, he added.

Remember that on the 13th of this month, a three-judge panel of the Appeal Court decided that the Nigerian government had violated international law when it extradited the IPOB leader from Kenya in June 2021.

The court then ordered the government to release Kanu from custody without condition after dismissing all of the accusations brought against him.

However, upon the transfer of the three justices, the Nigerian government petitioned the appeal court, requesting a stay of the earlier ruling’s enforcement.

In a decision that was overturned, the appeal court approved the government’s request. Kanu stayed in custody as a result.

Kanu would still seek to have his victory recognized by the Supreme Court, according to Ejiofor, who said this while providing an update on his routine visit to Kanu on Monday while he was being held by the Department of State Service (DSS) in Abuja.

Nnamdi Kanu did not think twice in giving our legal team the go-ahead to immediately start an appeal at the Supreme Court against the ruling of the Court of Appeal staying the execution of its judgement, which naturally will be heard under the Supreme Court Fast Track Rules. This is in addition to critical legal strategies that will remain private.

“Procedures for a quick hearing of the appeal were agreed upon, and since God is our Helper, we are extremely hopeful that it will still end in praises.

“As we had previously stated, rest confident that the Court of Appeal Judgment, which defended Nnamdi and so absolved him of all baseless accusations, still exists and has not been overturned.

“The legal team for Nnamdi Kanu, which is eminently led by Chief Mike Ozekome, SAN, will zealously pursue an appeal at the Supreme Court against the Court of Appeal’s ruling halting the implementation of Onyendu’s historic victory there.
