Police conclude investigation of alleged homicide case against Alhassan Doguwa

 

The Inspector General of Police Investigation team investigating the case of alleged culpable homicide against Alhassan Ado Doguwa, Majority Leader of the House of Representatives, has completed its mission and submitted its findings to the Kano State Ministry of Justice.

 

According to reports, the Kano Ministry of Justice is already planning to initiate full prosecution of Doguwa.

 

Musa Abdullahi Lawan, Kano State’s Attorney General and Commissioner for Justice, confirmed on Friday that the police have submitted the case file for their review and possible next steps.

Speaking to reporters in his office shortly after receiving the report on Friday afternoon, he stated, “I would like to assure the public that we will review the case file as soon as possible in order to render our legal opinion.”

Kano’s Attorney General informed the public that the Ministry of Justice had sent the case diary back to the police for further investigation, requesting that they provide more information on the allegations against the defendant to justify prosecuting Doguwa.

 

The ministry is requesting photographs of the bodies, witness statements, and the recovered firearm, among other evidence that will enable the prosecution to prove the alleged crimes as charged.

 

The Kano State Command of the Nigeria Police arrested and charged Doguwa, along with others, with criminal conspiracy and negligent homicide. He was also charged with causing great bodily harm, arson, and inciting a riot.

 

Doguwa allegedly committed the offence on February 26 in the Tudun Wada Local Government Area of Kano State, according to the police prosecutor.

The police stated that the offences violate Penal Code sections 97, 114, 221, 247, and 336.

 

Doguwa was initially charged in a magistrate court in Kano, but his attorney petitioned the Federal High Court for his release while challenging the magistrate court’s authority to hear the case.

 

In an ex parte application for the enforcement of his rights, however, Doguwa’s attorney, Senior Advocate of Nigeria (SAN) Nuraini Jimoh, asked the court to release the accused on bail on the grounds that the magistrate court lacks jurisdiction to hear the case.

 

The judge, Yunusa Muhammad, granted him bail in the amount of N500 million on the condition that he provide two sureties, one of whom must be a traditional ruler of the first class and the other a permanent secretary in the Federal Civil Service.

 

Muntari Garba Dandago, a retired Kano Chief Magistrate, recently petitioned the Kano State High Court for permission to issue an order of mandamus against the Kano State Attorney General for failing to prosecute the majority leader.

 

The case was scheduled to be heard on Monday, May 8, 2023, but could not proceed due to the judge’s absence in Adamawa State, where he was reportedly performing election petition tribunal duties.
